Boalemo – Dinilai terdapat kekeliruan dalam penetapan tersangka dana hibah KONI yang melibatkan salah satu Aparatur Sipil Negara di Lingkungan Pemerintah Daerah Kabupaten Boalemo. LSM Kaka Gempar menggelar aksi.
Aksi tersebut menyuarakan, bahwa Kejaksaan Negeri Boalemo dinilai keliru dalam menetapkan tersangka terhadap bendahara KONI.
Tak hanya itu, Sherman Tahala salah satu massa aksi menyampaikan adanya Kesewenang-wenangan oleh Aparat Penegak Hukum dalam penyelidikan hingga penerapan hukum dalam konstruksi Dakwaan pada sampel perkara pengaduan/aspirasi terhadap Perkara (Dugaan Penyimpangan Dana Hibah pada Pengelolaan Belanja Hibah Komite Olahraga Nasional Indonesia (KONI) Kabupaten Boalemo Tahun Anggaran 2018, Tahun Anggaran 2019 dan Tahun Anggaran 2020).
“Dalam perkara tersebut terdapat perbuatan yang sewenang-wenang kepada Organisasi Penerima Hibah yang notabene organisasi kemasyarakatan, tidak menghormati Peraturan dalam Rumah Tangga organisasi kemasyarakatan (AD/ART)” Ujar Sherman lewat press rilis tertulis yang dikirim ke media sharenews.id.
Lebih lanjut, Sherman menyebutkan bahwa APH dalam hal ini Kejari Boalemo menunjukan perilaku yang terkesan bertentangan dengan Ideologi Pancasila khusunya tentang Permusyawaratan, dan juga bertentang dengan Undang-Undang Dasar 1945, Undang-
Undang Ormas, Undang-Undang Pemerintahan Daerah (otonomi daerah), Undang-undang tentang Hak Asasi Manusia, Undang-undang tentang Sistim Keolahragaan Nasional, dan Peraturan Perundang-undangan lainya serta Peraturan Internal Organisasi (AD/ART).
“Perkara tersebut yang notabenenya merupakan perkara Dana Hibah KONI bersumber dari APBD dan telah ditegaskan tidak akan ada penyaluran/penyerahan hibah sebelum penandatanganan Surat Perjanjian Hibah yang
disebut NPHD, maka bila sesuai ketentuan Undang-Undang yang mengatur tentang Otonomi Daerah. Semestinya menjadi Kewenangan Pemerintahan Daerah memperkirakannya sebagai bentuk Penyelenggaraan Otonomi Daerah sehingga dengan adanya perkara ini yang diambil alih oleh Kejaksaan menjadi suatu Ironi kepada Pemerintahan daerah seakan Inspektorat dan DPRD yang berfungsi sebagai Pengawasan tak lagi mampu menjalankan fungsinya atau melaksanakan Penyelenggaraan Otonomi Daerah” Lanjut sherman.
Terakhir, Sherman Tahala berharap, dengan kasus tersebut, Kepala Negara Presiden Republik Indonesia antara lain meminta untuk memastikan tidak adanya saling melindungi antara lembaga penegak hukum secara vertikal dari atas ke bawah terhadap sesuatu yang melanggar hukum dan/atau hak asasi manusia sehingga dapat menjadi pelanggaran yang tersistematis secara kelembagaan.
